About Dr. Darius Paduch

Dr. Darius Paduch was a well known and highly regarded urologist in New York City and Long Island for many years. Dr. Paduch graduated from medical school in Poland and came to the U.S. where he became a specialist in male infertility treatment. He published many articles in the field of male infertility and was considered an expert.

Dr. Paduch spent most of his medical career at Presbyterian Hospital Weill Cornell Medical Center in New York City. He was employed there from 2003 to 2019. After leaving Presbyterian, Dr. Paduch went to work at Northwell Health on Long Island from 2019 to 2023.

Allegations of Sexual Abuse Against Dr. Paduch

Over the course of his career as a urologist, Dr. Paduch sexually abused countless male patients under the guise of providing medical care. Dr. Paduch would get patients alone in the exam room and then have them masturbate in front of him. He would often take pictures of their erect penis and have them watch pornography with him in order to get them erect.

In many instances, Dr. Paduch would actually masturbate patients with his own hand or with sex toys. Dr. Paduch was also accused of performing totally unnecessary rectal exams and engaging in other types of inappropriate sexual touching. All the while, Dr. Paduch would make sexually suggestive or vulgar comments to his patients.

Paduch would convince his victims that what he was doing was medically necessary. Paduch often had victims schedule follow up visits — resulting in some being abused by him repeatedly for multiple years. Paduch has also been accused of sodomizing patients with sex toys and performing surgical procedures on patients such as cystoscopies and varicocele surgeries, at times without anesthesia.

Criminal Case Against Dr. Paduch

In April 2023, Dr. Paduch was indicted in the Southern District of New York on criminal sex abuse charges involving his abuse of numerous male patients, including several who were minors. The criminal charges related to acts that occurred when Dr. Paduch was at both at both NY Presbyterian and Northwell Health. The charges against Paduch relate to events dating back to at least 2015. However, authorities suspect there may be more victims considering Paduch’s abusive patterns and his employment as a urologist since 2003.

On May 8, 2024, Paduch was convicted, following a two-week trial, of six counts of inducing a person to travel to engage in unlawful sexual activity and five counts of inducing a minor to engage in unlawful sexual activity. In November 2024, a federal judge sentenced Paduch to life in prison.

Civil Lawsuits for Sexual Abuse in New York

Under New York law, any survivor of sexual abuse or assault possesses the right to initiate a civil lawsuit and pursue financial compensation. Victims can bring a sexual abuse lawsuit in New York irrespective of whether criminal charges were filed in connection to the abuse. Notably, survivors retain the right to bring a civil lawsuit even if they never reported or disclosed the abuse to anyone at the time it occurred.

New York has made significant changes to its statute of limitations for civil sexual abuse claims, aiming to provide survivors with more time to bring their cases forward. For incidents of childhood sexual abuse, New York has eliminated the statute of limitations entirely. This means that survivors can file a lawsuit at any time, regardless of how long ago the abuse occurred. This change acknowledges that survivors may take years or even decades to come to terms with their abuse and decide to take legal action.

For adult survivors of sexual assault or abuse, different limitations may apply, and it’s important to consult with a legal professional to understand the specific time frames relevant to an individual case.

Initiating a civil lawsuit for sexual abuse is a straightforward process—victims only need to be willing to provide testimony about the abuse under oath. Supporting the claims can involve presenting additional evidence. Victims who bring civil sexual abuse lawsuits, especially against dirty doctors like Dr. Paduch, can get significant financial compensation.

Cases alleging sexual abuse by doctors consistently have high settlement payouts.  Our lawyers anticipate that the sex abuse lawsuits against Dr. Paduch will have an individual settlement range between $400,000 and $1,500,000.

There is already a significant amount of evidence showing that both hospitals definitely had knowledge of Dr. Paduch’s misconduct for years and did nothing.

How Are Sex Abuse Settlements Calculated?

Calculating settlement payouts in lawsuits involving serious allegations such as sexual assault can be complex and highly individualized, depending on the specifics of each lawsuit But there are common threads in calculating settlement amounts in sex abuse cases we can apply to these claims against Dr. Paduch.

There are three kinds of compensable injuries in these lawsuits: tangible (economic), intangible (non-economic), and punitive damages.

Economic Damages

Few sex abuse lawsuits have significant economic damages. Economic damages are quantifiable costs directly associated with the incident. They can include:

  • Medical Expenses: Costs for immediate and ongoing medical treatment resulting from the assault, including therapy and counseling.
  • Lost Wages: Compensation for any time the victim was unable to work due to the assault. We often see victims who cannot work after suffering a sexual assault at the hands of a doctor with allegations like those presented against Dr. Paduch.
  • Loss of Earning Capacity: If the assault has long-term effects on the victim’s ability to earn a living, this can also be considered.

Non-Economic Damages

Non-economic damages are what sex abuse lawsuits are really about.  The human suffering that comes from sexual abuse is what drives jury payout which in turn impacts settlement amounts.  These damages include:

  • Pain and Suffering: This refers to the physical and emotional distress caused by the doctor’s sexual assault.  Emotional distress and loss of enjoyment of life are really subcategories of pain and suffering. This umbrella term covers everything you have endured and will endure from the cruel abuse you have suffered—worry, grief, stress, humiliation, anxiety, etc.
  • Emotional Distress: For mental suffering, including anxiety, depression, PTSD, which doesn’t always have a direct financial cost but significantly affects the victim’s life.
  • Loss of Enjoyment of Life: Compensation for the victim’s reduced ability to enjoy daily life activities.

Punitive Damages

In some cases, if the defendant’s actions were particularly egregious, punitive damages might be awarded. These are intended to punish the wrongdoer and deter similar conduct in the future. Getting punitive damages against the doctor is easy in successful cases.  The key is getting punitive damages against the hospital or other institution that has the deeper pockets to pay such a settlement.
